Protect 7-OH in New York

New York lawmakers are advancing legislation that could effectively ban most natural 7-OH products statewide.

The primary threat is Senate Bill S8925-A / Assembly Bill A9156-B, which would prohibit the sale of products containing more than 2% 7-hydroxymitragynine or more than 1mg per serving.

The legislation is currently advancing in Albany and has become one of the most serious threats to consumer access in the country.

We Need Emails and Calls Today

Bill, A. 9156B, is likely to pass out of Assembly Ways and Means today, after which it will head to the Rules Committee and then to the floor.

So – we are just a couple of short steps away from a 7-OH ban becoming law in New York.

We are asking all advocates to contact all members of the New York State Assembly as soon as possible to oppose A. 9156B/S. 8925A. Below is a list of all Assembly emails.

We respectfully urge you to oppose A. 9156B/S. 8925A as currently drafted. While we support sensible consumer protections and appropriate oversight of kratom products, this legislation would effectively ban certain kratom products containing 7-hydroxymitragynine, or 7-OH, while leaving other forms of kratom unregulated. That approach does not advance public safety. Instead, it risks pushing consumers toward unregulated markets and more dangerous substances.

Millions of Americans use 7-OH products responsibly, and many report that these products help them avoid illicit drugs or more harmful alternatives. History has shown that prohibition rarely eliminates demand; it simply drives consumers underground, where products are less safe and accountability disappears.

Policymakers should follow the evidence and pursue regulation rather than prohibition. Available data do not support claims that 7-OH represents a widespread public health crisis, and leading researchers have urged lawmakers to carefully evaluate the science before restricting access.

New York has an opportunity to establish a comprehensive regulatory framework that protects consumers through strict age verification, licensing requirements, independent testing, clear labeling, potency disclosure, and restrictions limiting sales to age-gated establishments. Such an approach would address legitimate concerns while preserving access for responsible adults and those who rely on these products as a harm reduction tool.

We respectfully urge the Committee to reject A. 9156B/S. 8925A and instead pursue an evidence-based regulatory framework that protects public health, consumer safety, and individual choice.

Millions of Americans use kratom and natural 7-OH products for:

  • Chronic pain management
  • Harm reduction and opioid replacement
  • Stress relief and wellness support
  • Recovery support and improved quality of life

Industry and consumer advocates believe these proposed limits are not based on sound science and would effectively eliminate most existing 7-OH products from the legal market.

Instead of prohibition, we support:

  • Responsible regulation
  • Age restrictions (21+)
  • Clear labeling and testing standards
  • Child-resistant packaging
  • Milligram-based serving standards
  • Safe retail environments

A ban will not eliminate demand. It will only push consumers toward illicit or unregulated alternatives.
